The Phillipsburg City Council met in regular session on April 17, 2023, 6:00 P.M, at 945 2nd Street, Phillipsburg, KS.

The meeting was called to order by Mayor Bret Miles.

PRESENT: Councilmembers Terry McConnell; Jeanette Harris; Mike James; Pete Rogers; Tracy Sanson.

ABSENT: Vickie Gibbs.

ALSO PRESENT: Tim & Shawn Ellenberger; Daryl Clark; S. Scott Sage, City Attorney; Rachel Martin; Kirby Ross, Phillips County Review; Alex Parks; Pat Hewitt; Mike Reese; Kelly Bertholf; Lujeana Peters-Howell; Lauren Weinert; Tim Driggs, Director of Public Works.

The Pledge of Allegiance to the United States was led by Mayor Miles.

Lauren Weinert inquired about the curb painting that had been requested last fall. Kelly Bertholf inquired about a social media post. Miles indicated that the social media post could not be proven or unproven. Lauren Weinert inquired as to why the City Council minutes were so late being published in the paper.

Lujeana Peters-Howell Discussion of a license for a snow shack. Peters- Howell had requested clarifications from the council. Miles asked that Driggs work with her to get this resolved.

Moved by Rogers, seconded by McConnell to approve the April 3, 2023 minutes as written. Voting Aye: All. Opposed; None.

Miles inquired about Johnson Controls. Driggs indicated that it was the ADT system. Moved by James, Seconded by Sanson to approve ordinance #1055- 04-23A. Voting Aye: All. Opposed; None.

Driggs reported on activities of the Public Works Department Driggs said public works crews have been working on the campground, flower planters, and equipment repairs. Driggs reminded everyone that City Wide cleanup is May 1st through May 5th.

Driggs discussed a building permit request by the Phillipsburg Community Garden. Driggs indicated he didn’t have the ability to approve this permit. Moved by McConnell, seconded by Rogers to approve the permit. Voting Aye: All. Opposed: None.

Driggs presented a letter from KDHE about State Revolving Loan Funds. Driggs asked that if the Council had any projects in mind for this funding to please let him know and he will get things submitted. McConnell inquired about types of projects that are eligible for this funding. Driggs indicated that a lot of money will be focused on the Lead and Copper restrictions that are being focused on. Driggs indicated that he doesn’t feel we are in a place to go after this funding for this project at this time. Driggs also presented the grant award for the Public Transportation for FY 24. Driggs provided an update on the campground project and airport projects.

Driggs reported that there will be a Planning Commission meeting on April 19th and a Board of Zoning Appeals meeting on April 26th.

James motioned that the City Council recess into executive session for consultation with the attorney for the City Council or City for information deemed privilege in the attorney-client relationship exception K.S.A 75-4319 (b)(2) with the mayor and city council, Scott Sage and Tim Driggs in attendance and the open meeting to resume at 6:35 p.m. Seconded by McConnell. Voting Aye: All. Opposed; None.

Tim & Shawn Ellenberger; Daryl Clark; Rachel Martin; Kirby Ross, Phillips County Review; Alex Parks; Pat Hewitt; Lauren Weinert returned to the meeting at 6:35 p.m. Mayor Miles called the meeting back to order and indicated no action taken.

James motioned that the City Council recess into executive session to discuss an individual employee’s performance pursuant to the non-elected personnel matter exception, K.S.A. 75-4319 (b)(1) with the mayor and city council in attendance and the open meeting to resume at 7:05 p.m. Seconded by McConnell. Voting Aye: All. Opposed; None.

Tim Driggs and Rachel Martin returned to the meeting at 7:05 p.m. Mayor Miles called the meeting back to order and indicated no action taken.

Moved by James, seconded by McConnell to accept Tiffini Gross’ resignation and to advertise the position. Voting Aye: All. Opposed; None.

Moved by McConnell, seconded by Sanson to adjourn the meeting. Voting Aye: All. Opposed; None.
